CASE STUDYCase Study: Successful Spouse Visa Application Under Appendix FM
Background
Forest & Co Solicitors secured a spouse visa under Appendix FM for a client whose husband was settled in the UK. She instructed our team to prepare her entry clearance application so that she could join her family.
The couple first met in April 2024 and began their relationship in May that year. They later married in February 2026 in Barking and intended to live together permanently in the UK.
Our client also had two children already settled in the UK. Both had established lives within British society and education. The application therefore concerned her relationship with her husband as well as her role within the wider family.
Key Considerations
We needed to demonstrate that the relationship was genuine and subsisting and that the couple intended to live together. In addition, the application addressed the financial, accommodation, English language and suitability requirements.
The sponsor worked as a self-employed carpenter and sole trader. His financial records therefore formed an important part of the evidence. Alongside this, our representations explained the children’s reliance on their mother as their primary caregiver. We also addressed the potential emotional impact of prolonged family separation.
Our Approach to the Spouse Visa Application
We prepared detailed legal representations explaining how our client met the relevant requirements of Appendix FM. Each part of the application brought together the family’s circumstances and the evidence supporting it. This gave the Entry Clearance Officer a structured account of the relationship, finances and proposed living arrangements.
Relationship evidence
We set out the couple’s relationship history, from their first meeting through to their marriage. We also explained their intention to establish their home together in the UK. Together, these details supported our representations that the relationship was genuine and ongoing. The application presented the marriage within the context of the couple’s shared plans for family life.
Self-employment income
We demonstrated that the sponsor met the financial requirement through his self-employment. His income exceeded £55,000 for the financial year ending 5 April 2026. His income in the preceding financial year exceeded £42,000. As a result, the financial representations drew on records covering both years, alongside evidence that his work continued.
Supporting documents included:
- HMRC tax returns and statements of account;
- Bank statements;
- An accountant’s confirmation;
- Unique Taxpayer Reference details;
- Evidence of ongoing self-employment.
These documents supported the income figures and the account of the sponsor’s work as a sole trader.
Accommodation, English language and suitability
We provided evidence of suitable accommodation where the couple intended to live following the grant of entry clearance. In addition, our client held an approved Trinity College London English language qualification. The application used this qualification to demonstrate that she met the English language requirement.
We also addressed her immigration history and suitability. She had no criminal convictions, previous immigration refusals or history of immigration breaches. Our representations brought these matters together with the relationship and financial evidence.
The children’s circumstances
Alongside the evidence of eligibility, we highlighted the children’s established lives in the UK and their reliance on their mother. In particular, our representations explained how prolonged separation could affect their emotional wellbeing.
We therefore placed emphasis on their best interests and the importance of preserving family unity. This provided context for the application and explained its significance beyond the couple’s marriage. We submitted the completed application on 29 April 2026 using the standard service.
Outcome: Successful Spouse Visa Application
The Home Office granted our client entry clearance as a spouse under Appendix FM. As a result, she could join her husband and children in the UK. The decision enabled the family to pursue their plans to live together, following an application addressing each relevant requirement and the children’s circumstances.
Key Takeaway
This successful spouse visa application illustrates the value of clear legal representations and carefully organised evidence. Here, the sponsor’s self-employment records supported the financial case. At the same time, the relationship evidence and family circumstances explained the purpose of the application. Together, these elements presented a clear account of both eligibility and the importance of family unity.
